Terms of Sales
1. Generalities
By ordering and accepting the goods, the customer accepts the general conditions of sale and delivery of Vivacqua Suisse SA.
2. Confirmation of the order entry
When ordering, on line, the order is considered accepted validation on the Website.
3. Prices
The prices are in Swiss Francs including VAT and are intended for the account for the specialized trade. Prices are subject to change without notice.
4. Delivery time
Vivacqua Suisse SA indicates in its confirmation an approximative delivery date. It respects the delivery date according to the possibilities, the delay being not obligatory. In no case can the purchaser claim the right to compensation for the damage suffered.
5. Delivery
Deliveries are made at the discretion of Vivacqua Suisse SA depending on the fragility of the product, volume etc., by truck or Postal service. On request, deliveries can be made by express postal service, at extra costs.
The goods shall be distributed during working hours and shall be cleared by the consignee at the place of receipt.
It is the responsibility of the originator (address of delivery) to ensure that the consignee is present on the due day and acknowledges receipt of the goods.
6. Complaints
When transporting by truck, any transport damage must be reported to the deliverer upon arrival of the goods. Damage sustained during transport must be stated on the double of the delivery note. In the case of transport by post, the consignee must have a report or a certificate of the damage suffered, issued by the transport company. Such transport damage is covered by the corresponding carrier’s warranty. Complaints that do not contain a report or a certificate or a duplicate of the delivery note can not be taken into account. All deliveries must be checked for compliance with the order. Claims must be made within 8 days of receipt.
7. Terms of payment
For deliveries of goods: 100% on order.
8. Returns
Goods delivered and ordered correctly will only be exceptionally recovered and this only on the basis of a prior agreement of Vivacqua Switzerland SA. Returns of consumables are excluded!
9. Warranty
The standard warranty is one year (except for specific cases), the invoice date being the proof. The invoice of Vivacqua Suisse SA acts as a guarantee voucher; It must be presented when requesting repair under warranty.
Applicable law : the Swiss law is applicable
The exclusive legal forum is the registered office of Vivacqua Suisse SA.
